Rental Agreement in Kenya
A rental agreement is essential when it comes to property contracts. It does not matter whether you are the landlord, tenant, or real estate agent in charge of the property transaction. It binds the landlord and tenant legally. It also helps prevent misunderstandings between them. If there is any dispute, they can both refer to the agreement and clarify some matters. The deal helps tenants to understand what their terms are. The landlord is also assured that their property is safe with the tenants. They can be sure to take legal action against the tenant because it also serves as legal evidence. It is important to have a written agreement because you cannot always account for oral ones. Rental agreements in Kenya are as important as they sound. They are supported by the Kenyan constitution. This includes the Landlord and Tenant Act. This Act regulates the relationship between landlords and tenants. It applies to both residential and commercial spaces. It however excludes the exempted ones. CAP 176 of this Act specifically details more on shops, hotels, and catering establishments. Rental agreements help to set clear boundaries. They also define what expectations landlords and tenants have for each other. Tenants know what's required of them during their lease. The landlords know what to expect from their tenants and what they are also supposed to do.
