Landlord and Tenant Act

The purpose of the Landlord and Tenant Act is to define rental property laws, be it residential or commercial properties. It provides adjudication of disputes and connections. It regulates the relationship between landlords and tenants and aims to create ease and stability in the rental housing sector. It also creates grounds for problem-solving between landlords and tenants. This Act applies to all residential and some business premises. It, however, excludes excepted residential properties and those let on service tenancies. In addition, residential properties whose monthly rent exceeds the amount prescribed by the Cabinet Secretary are also excluded. It applies to a tenancy of a business premise that has not been reduced into writing, has been reduced into writing, and; is for a period not longer than 5 years and contains provision for a termination (other than a breach of contract) within 5 years from the day of commencement. This Act protects tenants and landlords from any form of exploitation. It also ensures fair practices within the rental housing sector.
