This is a document provided by the law of Kenya that guides the tenant and the landlord through an eviction process should one be necessary. The document stipulates the process to be followed by both parties to ensure a smooth process. Issuing an eviction notice serves as the initial process to the landlord of evicting a tenant from a premise. It is vital that both parties understand the do’s and do not’s and the role each party should play and how to follow the process accordingly as stipulated by the law so as to ensure the process is less strenuous and stressful. The following is everything you need to know about the document.
We have various types of evictions notices that are each served under varying circumstances, they could be broad but here we will analyze in depth three of the common ones:
The first one is the pay rent or quit notice: this particular notice is served to a tenant when they fail to raise the agreed rent amount on the stipulated date.
The second type is the cure or quit notice: this specific notice is served to a tenant due to breaking certain violations/rules or even damaging of the premises property which do not go according to the lease agreement.
The third type is the unconditional quit notice: this type of eviction notice is served particularly when a tenant has seriously violated a lease or could have engaged in illegal activities on the premises and also repeat offenses.
